FIATA issues urgent legal and insurance guidance amid escalating Middle East tensions

As geopolitical volatility in the Middle East continues to disrupt global trade routes, FIATA (the International Federation of Freight Forwarders Associations) has released a critical briefing to help freight forwarders mitigate escalating legal and financial risks.

  • Cost Recovery: Strategies for managing war-risk surcharges and deviation costs, ensuring contracts allow for the pass-through of these expenses.

  • Force Majeure: Practical steps for invoking “Acts of God” or war clauses correctly to limit liability.

  • Insurance Vulnerabilities: Identifying critical gaps where standard cargo policies may fail to cover war risks or losses due to delay.

  • Operational Contingencies: Managing “abandoned cargo” scenarios and mitigating exposure to demurrage and detention fees.

“The situation is evolving rapidly. Routes and surcharges can change in a matter of hours,” says FIATA. “It is imperative that forwarders understand their role—whether acting as a contractual carrier or an agent—to protect themselves from unforeseen exposure.”

The briefing includes a practical risk-management checklist designed for immediate implementation by operations teams to ensure customers are kept informed and shipments remain compliant with evolving international standards.
